England’s High Court has finally granted the enforcement orders in favor of the Office of Fair Trading (OFT) against two holiday clubs Personal Travel Group Limited (PTG) and Geo Demographic Market Research Ltd. (GDMR). The same orders are also applicable to seven more individuals, which includes two directors of PTG who served as directors of Incentive Leisure Group Limited (ILG), which is no longer trading and in liquidation.
As ILG is no longer trading and is facing bankruptcy in Gibraltar no interim enforcement order has been sought. However, the OFT is monitoring the liquidation proceedings and willing to take the appropriate legal action against the company.
The South East Regional Scambusters Team at Essex Trading Standards and OFT, decieded to act after receiving a series of complaints from consumers. Victims complained of being invited to presentations by PTG and GDMR sales representatives, who sold upmarket timeshare memberships of up to £12,000 or approximately $19, 340, with a garentee that they can dispose of their timeshares at any time and cut back on the annual maintenance charges. The perks include a 95% money back guarantee yet without clear explanations on the terms and conditions that apply.
By virtue of the court orders, the involved companies and individuals are prohibited from using misleading sales and marketing practices in promoting timeshare membership and other related products that tend to violate consumer rights.
As of the moment, no date for the final hearing has yet been set. OFT has promised to put a stop to any unlawful trading practice and protect consumers’ rights.
